Terms of Service.
These Terms govern Persona, the Persona website, the account portal, and related services provided by Kam Studios, LLC.
1. Agreement
By downloading, accessing, creating an account for, or using Persona, you agree to these Terms. If you use Persona for an organization, you represent that you can bind it to these Terms.
2. Beta access
Persona is a limited, experimental beta. We may approve, deny, limit, pause, change, or revoke access at any time. Features may change or disappear. We do not promise availability, continuity, compatibility, support response times, or that any beta feature will become generally available. Keep your own backups; Persona is not a backup system.
3. Eligibility and accounts
You must be at least 13, or the minimum age where you live. The current beta is intended for users in the United States. Keep your account information accurate and protect the devices and credentials used to access it. Invite codes are personal, revocable, and not transferable.
4. Your work and content
You retain ownership of posts, captions, briefs, brands, media, feedback, and other material you submit or create. Nothing in these Terms transfers ownership to Kam Studios. You grant us only the limited rights needed to provide, secure, maintain, troubleshoot, and improve the Services. For the current local-first library, we do not receive or host the library itself.
You represent that you have the rights and permissions needed for your content and that using it with Persona does not violate law or another person’s rights. Do not submit confidential, regulated, or highly sensitive information unless a feature expressly calls for it.
5. License and acceptable use
Subject to these Terms, Kam Studios grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use Persona for lawful purposes during the beta.
You may not copy, sell, rent, lease, sublicense, distribute, reverse engineer, decompile, extract source code, bypass access controls, scrape, overload, or interfere with Persona; use it to build a competing service; abuse, defraud, harass, impersonate, or harm anyone; upload malware; or circumvent beta controls.
6. AI and third-party services
AI output may be inaccurate, incomplete, biased, or unsuitable for publication. Review it, check rights and facts, and decide what to publish. AI output is not legal, financial, medical, or other professional advice.
Persona may depend on Apple, iCloud, GitHub, Cloudflare, Turnstile, Anthropic/Claude, and other providers. Their services have separate terms and privacy policies, and we are not responsible for their outages, changes, or content. If you connect Persona to Claude, your use of that connection is also governed by Anthropic's terms.
7. Intellectual property and feedback
Persona, its software, interface, designs, names, trademarks, documentation, and related materials belong to Kam Studios or its licensors. These Terms grant no ownership of them. Suggestions about Persona may be used by Kam Studios without compensation or attribution; we will not use your content as a public testimonial without permission.
8. Privacy
Our Privacy Policy explains what Persona receives, how it is used, retention, third-party providers, and your controls. It is part of these Terms.
9. Fees and changes
The current beta is free unless we clearly say otherwise. We may introduce paid plans, limits, or different features later; any paid offering will present additional terms before purchase. We may update these Terms by posting a new version and will give reasonable notice for material changes where practical.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES. KAM STUDIOS DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, SECURITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT PERSONA WILL PRESERVE, SYNC, BACK UP, OR RECOVER YOUR CONTENT, OR THAT AI OUTPUT WILL BE ACCURATE OR SAFE TO PUBLISH.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAM STUDIOS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS; OR SUBSTITUTE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO PERSONA OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) WHAT YOU PAID US IN THE PRIOR 12 MONTHS OR (B) $100.
12. Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Kam Studios and its personnel, licensors, and service providers from claims, losses, liabilities, costs, and reasonable attorneys' fees arising from your content, misuse of Persona, violation of these Terms, or violation of law or another person's rights.
13. Suspension and termination
You may stop using Persona or delete your account through the account controls. We may suspend or terminate access for security, legal, operational, or beta-program reasons. Ownership, licenses, disclaimers, liability limits, indemnity, and dispute provisions survive termination.
14. Governing law and disputes
These Terms are governed by Tennessee law. To the extent a dispute may be brought in court, you and Kam Studios agree to personal jurisdiction and venue in the state or federal courts located in Williamson County, Tennessee, unless applicable law requires another forum. Before filing a claim, contact kamren@kamstudios.com and give us 30 days to try to resolve it.
